1. scope
1.1. The following terms and conditions (Terms) regulate exclusively the relationship between the CollegeEmpire educational goods (limited liability), Berliner Str. 45, 21481 Lauenburg, and their customers for all contracts with CollegeEmpire Bildungsgüter (limited liability), hereinafter referred to as CE for the tutoring services it offers. The terms and conditions apply to contracts, which via the German-language online portal of the CE (https://www.peterjungblut.de) as well as at the locations of the CE.
1.2. These terms and conditions are available at https://www.peterjungblut.de/agb/ available.
1.3. If in the following from the “Customers” is spoken, this means the contractual partner of CE. “Registered person” means that person, who then makes use of the tutoring offer of CE on the basis of a concluded contract.
2. General implementation
2.1. The CE offers tutoring at the customer's home as well as tutoring courses on site at the CE locations. Unless only tutoring at the customer's home or tutoring courses on site are expressly addressed in the following, The following regulations apply to all tutoring offers of the CE.
2.2. Only the person registered for tutoring may use the services in accordance with the contract. Claims by third parties are not permitted.
2.3. The CE is authorized, to have the contractual obligations carried out by freelancers and expert third parties.
2.4. In class, additional learning materials are used in addition to the learning materials of the public school, which may only be reproduced or passed on to third parties after consultation with the CE and its consent.
3. Group size and duration of the lesson
3.1. Individual support in small learning groups
The tutoring- and remedial instruction in secondary school can also be done in small, homogeneous learning groups of 3-5 Students take place. In special exceptional cases, this number can be extended to include a trial student for a limited period of time. One lesson includes 90 Minutes. If there is temporarily no study group with a minimum of three students, the lesson is reduced to 45 Minutes.
3.2.One-to-one tuition
One lesson includes 90 Minutes.
3.3. subject- and competence courses
subject- and one-to-one competence courses have a duration of 90 Minutes, depending on the agreed offer. Includes a group lesson unit 90 Minutes. If the number of participants falls to less than three students in the course of the course, the course will nevertheless be continued in full. subject- and competence courses follow a fixed grid and usually take place in group lessons. Therefore, an hour missed by a student cannot be made up.
4. School holidays
Classes take place during all holidays except the Christmas holidays, on Carnival Monday, Maundy Thursday to Easter Tuesday and on public holidays of the respective federal state. During the summer holidays, lessons take place in the form of intensive courses, the respective scope of which corresponds to the contractually agreed teaching hours. The normal fees apply for these lessons during the summer holidays.
5. Absent hours
We try hard, in excused absence (Illness or other justified cases, knows z. B. school events, Practice o. Ä.) to give replacement lessons if possible. However, there is no entitlement to this.
6. Prices and terms of payment, Late payment
6.1. The prices and terms of payment agreed in the contract apply. The prices are net prices; in addition, the customer owes the applicable sales tax. The services of the CE in the field of tutoring are currently according to § 4 No. 21 a) UStG exempt from sales tax.
6.2. The current contributions of a term contract are in each case to 1. or 15. due one month in advance. The payments owed by the contractual partner are collected by SEPA direct debit, unless another method of payment has been agreed. The registration fee will be debited together with the first monthly debit.
6.3. If the customer wants a different method of payment than the SEPA direct debit procedure, the contribution must be paid no later than 3. Working day of a month in advance. In this case there is an additional fee of 5,00 € monthly. The total amount due under a contingent contract is collected before the start of the tutoring by SEPA direct debit or is to be paid by the customer by the start of the tutoring.
6.4. Payments are stating the customer- and contract number to be paid to the account, which was communicated to the customer when the contract was concluded.
6.5. The customer bears the costs of any return debits that may arise.
6.6. If the customer is in arrears with the payment of at least two monthly contributions, so the CE is entitled, to terminate the contract extraordinarily for an important reason. In this case, the CE is authorized, to calculate a lump-sum compensation. This is calculated from the selected contract type and the actually used contract duration. The contract partner is allowed to provide evidence, that no or significantly less damage has occurred.
7.Notice periods
Notice periods apply according to the contract. The termination must be in writing.
8. privacy
8.1. Consent to the use of the customer's data or. of the registered person
The CE collects and uses the personal data of the customer or. of the registered person in compliance with the applicable data protection regulations. The personal data is used for the purpose of processing the contractual relationship with the customer. The customer agrees with this survey, Processing and use of his personal data. – The contact details (Email address and phone number) are required for any queries that may be required. They are also used to receive information and news, Offers or other marketing measures, provided the customer has consented to this;
– The details of the school attended, the type of school and the grade are required, in order to be able to classify the registered person in suitable learning groups;
– The account details are required, in order to be able to collect the agreed fees, if the customer has issued a SEPA direct debit mandate.
9. Final provisions
9.1. Oral side agreements have not been made. Any subsequent changes to the present contract through verbal agreements must be made in writing for reasons of evidence.
9.2.Should one or more provisions of these terms and conditions be or become legally invalid, should there be a loophole or should any of the contractual provisions prove impracticable, this does not affect the legal validity of the other provisions or. the terms and conditions per se.
9.3. The CE is neither willing nor obliged, to participate in dispute settlement proceedings before a consumer arbitration board.
